Florida AG Charges Canadian Citizen Accused of Voting in Seven Elections

TALLAHASSEE, Fla. — Florida Attorney General James Uthmeier announced felony charges Thursday against a Canadian citizen accused of registering to vote in Brevard County and casting ballots in seven elections over two decades.

Giorgio Dominique Mucelli, 66, of Melbourne, is a Canadian citizen and lawful permanent resident of the United States, according to the Florida Attorney General’s Office.

State investigators allege Mucelli registered to vote in Brevard County on April 9, 2004, after falsely affirming that he was a U.S. citizen.

The Attorney General’s Office said voting records showed Mucelli cast ballots in the 2004, 2006, 2008, 2012, 2020, 2022 and 2024 elections.

The allegations have not been proven in court, and Mucelli is presumed innocent unless convicted.

FDLE Election Crime Unit investigated case

The Florida Department of Law Enforcement’s Election Crime Unit investigated the case and obtained information indicating that Mucelli was ineligible to vote because of his citizenship status, according to state officials.

Investigators allege Mucelli initially provided false information when questioned about his voting history before acknowledging that he knew he was not permitted to vote.

“Florida will not allow non-citizens to steal the vote of Americans at the ballot box,” Uthmeier said when announcing the charges.

The Attorney General’s Office described the charges as voting by a noncitizen elector and making a false affirmation.

Published Brevard County booking information shows Mucelli was arrested on a warrant in Indialantic at 8:18 a.m. Tuesday and booked into the county jail shortly before 1 p.m. The booking record lists charges under Sections 104.15 and 104.013(1) of Florida law.

The booking record identifies the offenses as voting by an unqualified voter and a voter-information-card violation.

Florida law makes illegal voting a felony

Section 104.15 of the Florida Statutes makes it a third-degree felony for someone who knows they are not a qualified elector to willfully vote in an election.

Florida law separately prohibits knowingly possessing a forged, counterfeit, fictitious or unlawfully issued voter information card without authorization.

Violations of either provision can be prosecuted as third-degree felonies. A conviction for a third-degree felony can generally result in up to five years in prison, although any sentence would be determined by the court based on the charges, criminal history and other applicable factors.

The Attorney General’s announcement did not identify an attorney representing Mucelli or include a response from him.

The Florida Pundit has not independently obtained the arrest affidavit or reviewed the complete voting records cited by investigators. The number and dates of the alleged votes are based on information released by the Attorney General’s Office.

Case announced ahead of Florida primary

The charges were announced less than three weeks before Florida’s Aug. 18 primary election.

Florida’s deadline for voters to request that a primary vote-by-mail ballot be mailed is Aug. 6. Mandatory early voting runs from Aug. 8 through Aug. 15, although counties may offer additional early-voting days.

The case also comes as Florida officials continue emphasizing election-law enforcement and voter-roll eligibility ahead of the primary and Nov. 3 general election.
