WASHINGTON, D.C. — Former White House COVID-19 adviser Dr. Anthony Fauci invoked his Fifth Amendment right against self-incrimination 111 times during a Senate Homeland Security and Governmental Affairs Committee hearing chaired by Sen. Rand Paul (R-Ky.), declining to answer questions related to the federal government’s COVID-19 response, the virus’s origins, and other matters under investigation.
The hearing came days after Chairman Rand Paul released thousands of pages of Fauci’s journals and related records, documents the senator says are central to the committee’s ongoing investigation.
The Florida Pundit also recently reported that Florida Attorney General James Uthmeier said his office expects to issue subpoenas next week as part of a separate state-level investigation involving Fauci.
Fauci appeared before the committee after being subpoenaed by Paul, who has spent years examining the government’s pandemic response and repeatedly questioned Fauci’s testimony regarding federal funding for virus research and the origins of COVID-19.
Before questioning began, Fauci delivered a brief opening statement explaining that, on the advice of counsel, he would invoke his constitutional right against self-incrimination.
“Under the advice of my attorneys, I will invoke my right under the Fifth Amendment of the Constitution to refrain from answering your questions.”

Fauci also stated that he believed the hearing was designed to create grounds for criminal prosecution rather than obtain factual information, citing what he described as Chairman Paul’s repeated public calls to have him prosecuted.
Throughout the hearing, committee Republicans posed questions concerning the government’s pandemic response, gain-of-function research, communications surrounding COVID-19’s origins, and recently released personal journals maintained by Fauci during the pandemic.
Rather than responding to each question, Fauci invoked the Fifth Amendment 111 times.
Rand Paul Signals Contempt Referral
Following the hearing, Paul indicated he intends to pursue contempt of Congress proceedings against Fauci, arguing the former public health official refused to cooperate with a lawful congressional investigation.
Under Senate procedures, a contempt referral would require additional committee and Senate action before being transmitted to the U.S. Department of Justice, which would determine whether criminal prosecution is appropriate. Legal experts note that several constitutional questions—including the scope of Fauci’s Fifth Amendment protections and the legal effect of a presidential pardon covering earlier conduct—could become central issues if the matter proceeds.
Long-Running Dispute
The hearing marked the latest chapter in the years-long public dispute between Paul and Fauci.
Paul has accused Fauci of misleading Congress regarding National Institutes of Health funding connected to research conducted in Wuhan, China, and has argued that additional oversight is necessary to fully examine the federal response to COVID-19.
